CIVIL LAW

Daily life is shaped by civil law, i.e. the BGB .

Here I advise or represent you, among other things:

Three Germans: One association (eV). Not correct! At least 7 founding members are required. And a statute along with the board of directors and the general assembly. And off we go  with the problems. But the GbR is not without the same.

Ask a lawyer if the board doesn't want to do the same as the general meeting.

Receivables management , i.e. the defense against unjustified or the enforcement of justified monetary claims. Here I can first of all offer you the judicial dunning procedure "payment order" relatively inexpensive, because I work largely online: That means you send me your claim by fax, email or post, such as a dunned invoice. I can then initially enforce this in court with what is known as an online dunning procedure. Conversely, of course, also fend off. A summary success prognosis can be settled on request in the form of an initial consultation. For you as a consumer at a fixed price of up to € 190 + 19% VAT. A very manageable cost-benefit ratio.

Tenancy law and residential property law (WEG-new).

While the application of the WEG has been significantly simplified due to the amendment, this unfortunately cannot be seen in the case of apartment rental law. Ask us about cancellation, reduction or cosmetic repairs, the classics.

And then there is the neighbor law , loosely based on Schiller: "The most pious cannot live in peace if the evil neighbor does not like it." The crowing of the rooster in the morning is pure peaceful nature for the animal keeper; bodily harm for the neighbor on the late shift. And Great Dane Bello just wants to play for the pet owner, but the mother on the neighboring property wonders if Bello knows that too. The chain-link fence comedy has haunted the legal world and ultimately has a background that lawyers should also take seriously, who otherwise prefer to deal with more lucrative mergers & acquisitions or company compliance. Because  this is about the full life and quality of life and unfortunately sometimes also about abrupt overdevelopments in the other direction. That is why not only pure specialist knowledge is required here - albeit indispensable *) - but also skill, life experience and diplomacy. and  The lawyer must always consider the cost-benefit ratio. Because it's often about little things, but about big emotions. Neighborhood law is predominantly state or even municipal statute law.  An out-of-court representation mandate is usually required here, the fees of which depend on the value of the item or a free agreement. The request for this is initially free of charge.

*) Even the legal process can be a problem: Would you have thought that the ringing of the church bells and the hourly bell of the tower clock require "maximum" legal concentration?

A lawsuit against the ringing for church services would have to be filed with the administrative court. The chime of the tower clock, which can wake the neighbors from their sleep every hour, is, however, a matter for the local court. That's how they are, the lawyers, at least those of the BVerwG, who decided it that way. Better to go to a lawyer!
